What Are the Reported Sig Sauer p320 Defect Claims?

A pistol that fires without a trigger pull is every gun owner’s worst fear.

The Sig Sauer p320 has faced that exact accusation in courtrooms across the country. Because firearm defects are the focus of Wheeles & Garmon Attorneys, the P320 accusations fall within the firm’s practice. Claims about the pistol are serious, but they remain allegations until a court decides. Sig Sauer firmly denies that the pistol can fire without the trigger being pulled. Weeks after an unexpected P320 shot, the injured person is comparing attorneys for accidental discharges.

Where the P320 Claims Began

Sig Sauer introduced the p320 as a modular striker fired pistol with wide appeal. The military adopted versions of it, and many police departments soon followed that lead. Reports of uncommanded discharges began to appear in the early years after its release. In 2017, Sig Sauer offered a voluntary upgrade program that updated the trigger mechanism. Critics say the upgrade did not end the lawsuits or the ongoing safety concerns. Filings over the p320 span several states, and some come from both uniformed owners and civilians.

What Plaintiffs Say Happened

In one lawsuit, the plaintiff alleges the pistol fired inside its holster during an ordinary day of carrying it. Many say their fingers were nowhere near the trigger when the shot went off. After the shot, several plaintiffs found a bullet wound in the foot or lower leg. Several lawsuits also focus on the lack of a manual safety on standard models. Others claim the company marketed the pistol as safer than the evidence actually supports. A jury in a P320 case hears from engineers before it believes a pistol fired on its own.

How Sig Sauer Responds

Sig Sauer says the p320 is designed to fire when the trigger is pulled. The company says it has been unable to recreate an uncommanded discharge in testing. It has also argued that outside groups are targeting the pistol through repeated lawsuits. Sig Sauer has won some cases, and many other claims have been dismissed already. It has also settled at least one class action involving pistols made before 2017. Because the results split, a lawyer studies each owner’s pistol before promising a client any outcome.

What Courts Have Looked At

Juries in Georgia and Pennsylvania have returned verdicts against Sig Sauer in separate cases. Sig Sauer has challenged those results, so parts of the legal story remain unfinished. Some courts have allowed expert testimony about alleged design defects to reach a jury. An expert hired by one side strips the pistol down and watches how its firing parts move. Meanwhile, the opposing expert tests whether an outside cause, such as a loose holster, pressed the trigger. By the end of the trial, jurors side with whichever expert showed the cleaner test.

Steps to Take After a Discharge

First, make the firearm safe and keep it well away from children and others. Get medical care quickly, even if the injury seems small or harmless at first. Write down exactly how the gun was carried, stored, and handled before the shot. Keep the pistol, holster, magazine, and receipt exactly as they were after the incident. Do not clean, repair, or return the gun before an independent expert inspects it. Filing deadlines vary by state, so waiting can close the door on a claim.

Nobody wants to wonder whether a loud bang was their fault or the gun’s. That doubt can weigh heavily on you long after the injury starts to heal. The truth is that these claims are still being sorted out in many courts. Sig Sauer stands by the pistol, while injured owners point to evidence that disagrees. Whatever you believe, your own safety and your own facts are what matter most. So save what you have, ask questions early, and never let anyone rush you.
